Worked examples at $20 an hour

  • Five 10-hour days, federal rules: 40 regular + 10 overtime hours = $1,100.00.
  • Same week in California: 8 regular hours a day and 2 overtime hours a day = 40 regular + 10 overtime = $1,100.00.
  • One 13-hour day in California: 8 regular, 4 at 1.5× and 1 at 2× = $320.00.

Frequently asked questions

How is overtime calculated?+

Under federal law (FLSA), non-exempt employees earn 1.5 times their regular rate for every hour over 40 in a workweek. Multiply your hourly rate by 1.5 for the overtime rate, then by the overtime hours. Some states add daily overtime on top.

What is time and a half for $20 an hour?+

$30 an hour. Double time would be $40 an hour.

How does overtime work in California?+

California pays 1.5× for hours over 8 in a workday or 40 in a workweek, 2× for hours over 12 in a workday, and on the seventh consecutive day of work 1.5× for the first 8 hours and 2× after that. Hours aren't counted twice — daily overtime hours don't also count toward the 40-hour weekly total.

Is overtime taxed more?+

No. Overtime is ordinary wages. A big overtime paycheck can have more withheld because payroll annualizes it as if you earned that much every week, but your actual tax rate is the same — extra withholding comes back when you file.

Who doesn't get overtime?+

Exempt employees — generally salaried executive, administrative and professional staff who meet the salary and duties tests — and some specific jobs. Check your job classification with your employer or state labor department.

Do 10-hour shifts earn overtime?+

Federally, four 10-hour days (40 hours) earn no overtime, but five do (10 hours of OT). In California every hour past 8 in a day is overtime, so five 10-hour days at $20 pay $1,100.00 instead of $1,100.00 — unless your employer has a valid alternative workweek schedule.
